1. Scope of Facilitation Services
The Applicant acknowledges and agrees that iVisa Tours is an independent, non-governmental visa consultancy service provider. Its scope of work is strictly confined to the following administrative and advisory services:
* Online visa application processing and submission support.
* Booking biometric appointment dates (subject to official availability).
* Application status tracking updates following formal submission.
* Visa interview guidance and training.
* Organization and formatting of the required document file.
* Direct customer assistance via Email, Phone, and WhatsApp.
2. Decision-Making Authority & Explicit Disclaimer of Guarantee
* Sole Embassy Discretion: Pursuant to international immigration law and consular protocols, the power to grant, refuse, delay, or modify visa applications rests exclusively with the concerned Embassy, High Commission, Consulate, or Ministry of Home/Foreign Affairs.
* No Agency or Control: iVisa Tours holds no official representation, administrative control, or influence over embassy decisions or processing timelines.
* Non-Liability for Outcomes: iVisa Tours, its proprietors, directors, employees, or associates shall not be held liable for any visa refusal, administrative delay, loss of travel arrangements, or secondary damages arising from embassy actions.
3. Fees, Charges, and Absolute Non-Refundability
* Obligation to Pay: The Applicant agrees to pay all applicable Visa Government Fees, Embassy/VFS Charges, Third-Party Out-of-Pocket Expenses, and iVisa Tours Consultancy Service Fees.
* Non-Refundable Consideration: In accordance with Section 2(11) of the Consumer Protection Act, 2019, the service fee paid to iVisa Tours is for professional work rendered in documentation support. Therefore, all service charges, embassy fees, and government levies are 100% non-refundable, irrespective of whether the visa is approved, delayed, or rejected, or if the Applicant chooses to withdraw the application.
4. Document Authenticity & Applicant Responsibilities
* Genuine Documentation: The Applicant warrants that all personal details, financial records, travel history, and supporting documents provided are authentic, accurate, and unedited.
* Consequences of Fraud: iVisa Tours shall not be responsible for visa rejections resulting from inaccurate, fraudulent, or missing documentation supplied by the Applicant.
5. Personal Attendance, Travel Expenses, and Assumption of Risk
* Personal Attendance: The Applicant must personally attend all mandatory appointments at the respective Embassy, High Commission, or Visa Application Centre (e.g., VFS/TLS/BLS) on the scheduled date and time with original prescribed documents.
* Expenses & Risk: All travel, accommodation, conveyance, and incidental costs incurred for attending visa appointments are borne solely by the Applicant. iVisa Tours assumes no liability for missed appointments, travel delays, personal injury, loss of belongings, or logistical issues encountered during transit or on embassy premises.
6. Indemnity & Non-Disparagement
* Indemnification: Under the Indian Contract Act, 1872, the Applicant agrees to indemnify and hold harmless iVisa Tours against any financial losses, damages, or third-party claims arising from misrepresentation, false documentation, or breach of terms by the Applicant.
* Protection of Goodwill: The Applicant agrees not to post misleading, defamatory, or false content on online platforms, social media, consumer forums, or public domains aimed at damaging the business reputation of iVisa Tours as a result of an embassy’s visa refusal.
7. Governing Law, Dispute Resolution & Exclusive Jurisdiction
* Governing Law: This Agreement shall be governed by and construed in accordance with the substantive laws of India.
* Arbitration & Venue: In the event of any dispute or difference arising out of this service agreement, the parties shall first attempt to resolve it amicably. If unresolved, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996.
* Exclusive Jurisdiction: Subject to arbitration, the Courts having jurisdiction over the registered business address of iVisa Tours (e.g., Courts at Ahmedabad, Gujarat, India) shall have exclusive jurisdiction over all matters arising out of or in connection with this agreement.

I, the undersigned Applicant, confirm that I have read, understood, and accepted all the terms, non-refundability policies, and disclaimers outlined above. I acknowledge that iVisa Tours is solely providing document assistance and that visa approval remains at the sole discretion of the embassy.
